Buying in Crete as a Dutch Citizen: Box 3, the Greek Treaty and the Ten-Year Inheritance Rule
A Dutch passport makes buying and living in Crete simple; the tax is where the two countries meet. How box 3 counts a Cretan house and Dutch double-tax rules can take most of that tax back out, what is law and what is only planned in the box 3 reform, why Dutch inheritance tax follows emigrants for ten years, and the M-form, AOW and health cover if you move.
A Dutch passport makes the Cretan side of buying simple: an EU citizen buys, lives and works here without a permit. The tax side is calmer than box 3’s reputation suggests. A Dutch resident declares the Cretan house in box 3, Dutch rules for avoiding double taxation can then take most of the Dutch tax on it back out, and the rent is taxed in Greece. Two things need planning: the box 3 reform expected in 2028, and an inheritance-tax rule that follows Dutch nationals for ten years after they leave. Rules as they stood in October 2026, checked against the Belastingdienst, wetten.overheid.nl, the Dutch government, e-EFKA and Greek sources.
I am not a tax adviser or a lawyer, and this is not tax or legal advice. Take advice from a Dutch belastingadviseur who handles foreign property, and from a Greek accountant, before you sign, let or move.
A Dutch owner in Crete in one minute. As an EU citizen you need no permit. While you live in the Netherlands, the house sits in box 3 at its market value, unoccupied and unrented; in 2026 box 3 assumes a 6.00% return on it, taxed at 36% above an allowance of €59,357 a person. Dutch rules can then reduce the box 3 tax by the house’s share (Besluit voorkoming dubbele belasting 2001, arts. 22–24), with the 1981 Netherlands–Greece convention, in force since 1984, applying first. Greece taxes the rent, 15% up to €12,000 and 25% up to €24,000 in 2026, and its tax on property gains is suspended until 31 December 2026. A box 3 on actual returns from 1 January 2028 has passed the Tweede Kamer and awaits the Eerste Kamer: planned, not law. Dutch inheritance tax treats a Dutch national as resident for ten years after emigrating (Successiewet 1956, art. 3).
The Cretan side is the EU side
Buying takes the paperwork every foreign buyer needs: a Greek tax number (AFM), a bank account, a lawyer and a notary. Living here is free movement, with a police registration after three months; the counters and their order are in moving to Crete as an EU citizen. None of that decides where you pay tax.
Box 3: counted, then taken out
The Belastingdienst’s 2026 figures give investments and other assets a deemed return of 6.00%, taxed at 36% above an allowance of €59,357 per person, or €118,714 for fiscal partners. A home abroad is entered at its market value, unoccupied and unrented, on 1 January of the year before the tax year, or at a percentage of it if let to a tenant protected by local law.
Then the relief. The Belastingdienst’s general rule is that you may be entitled to a reduction to avoid double taxation where a treaty lets the other country tax. For assets abroad the computation is in articles 22 to 24 of the Besluit voorkoming dubbele belasting 2001: property in another country forms a “foreign return base”, counted only insofar as its income is subject to an income tax there, and the box 3 tax is cut in the proportion that base’s return bears to your box 3 income. With Greece, the convention of 16 July 1981, in force since 17 July 1984 and amended by a 2006 protocol, applies first. Have your adviser confirm how it treats a house you do not let: that income-tax condition is where a holiday home can fall between two systems.
Rent and sale: Greece taxes, box 3 does not add to it
Greece taxes the rent at source: under the 2026 scale, 15% up to €12,000, 25% up to €24,000, 35% up to €35,000 and 45% above. The short-let rules are in renting out your Crete home. In the Netherlands the house stays in box 3, let or not, which taxes a deemed return on its value rather than the rent. Box 3 has no separate tax on a sale.
The Greek side of a sale is a date: the tax on property gains by individuals, article 41 of the Income Tax Code, is suspended until 31 December 2026 by article 90 of law 5162/2024. Check whether a bill extending it through 2027 has passed before timing a sale; see selling a property in Crete.
The reform: what is law and what is planned
What is law for 2026 is the deemed return, and the right, since the Supreme Court’s rulings and the Wet tegenbewijsregeling box 3, to be taxed on your actual return when it is lower.
What is planned is a box 3 on actual returns, which the cabinet wants to start on 1 January 2028. The government’s page, last changed in July 2026, says the Tweede Kamer has passed the bill and the Eerste Kamer has still to deal with it. For a second home or a let home the plan taxes rent as it comes, allows costs such as maintenance and interest, and taxes the rise in value only when it is realised, for example on a sale. Neither it nor the Belastingdienst, which still writes “probably” 2028, says anything specific about property abroad.
Inheritance and gifts: the ten-year rule
Under article 3 of the Successiewet 1956, a Dutch national who lived in the Netherlands and dies within ten years of leaving is treated as still living there, so the whole estate, the Cretan house included, falls under Dutch inheritance tax. The same ten years apply to gifts, or one year for a non-Dutch former resident.
The government’s treaty overview of 1 October 2026 lists inheritance-tax treaties with Finland, Israel, Austria, the United Kingdom, the United States, Sweden and Switzerland; for Greece only the income-tax convention and its protocol. Greece taxes the house under its own bands, in inheritance, gifts and wills for a Crete home, and the Belastingdienst says only that rules may prevent double taxation, for instance by letting heirs deduct the foreign tax. Dutch rates in 2026 are 10% up to €158,669 and 20% above for a partner or child, after exemptions of €828,035 for a partner and €26,230 for a child.
Moving to Crete: the M-form, the AOW and health cover
In the year you move you file an M-aangifte, the return for a year lived partly in the Netherlands. Once Crete is your home, Greece taxes your worldwide income; its regimes for newcomers are in tax residency and the 183 days, and where your Dutch pension is then taxed is a question for the 1981 convention and your adviser before you elect anything.
The AOW is the quiet cost. With no Dutch income after emigrating, the Belastingdienst says you are no longer insured for the national insurance schemes and stop building up AOW. Each uninsured year cuts the AOW by 2%, and the Dutch government says voluntary insurance with the Sociale Verzekeringsbank can be requested up to one year after you leave. A pensioner insured through the Netherlands registers for Greek care with an S1, which e-EFKA describes as issued by the insuring state; the Greek side is in healthcare in Crete for residents.
The honest downside
Box 3 makes you declare a house whose Dutch tax is relieved only if the conditions are met, and an adviser has to check them against a 1981 convention, especially for a house you do not let. The 2028 reform awaits the Senate and says nothing specific about a home abroad. The ten-year inheritance rule outlasts most plans, and with no inheritance-tax treaty with Greece on the government’s list, two taxes can meet on one house. And leaving stops your AOW accrual unless you insure within the year.
Disclosure: Honest Crete does not sell or list property. Enquiries sent from this section go to a licensed estate agent, not to us; the full statement is below. Nothing in this article names a developer, a property, a lawyer, a belastingadviseur, an accountant or any other professional; the Belastingdienst, the Sociale Verzekeringsbank and e-EFKA are named as the public institutions they are.
Worth it if you want a Cretan house while living in the Netherlands and will have an adviser check the box 3 relief, or you are moving for good and have planned the AOW year and the ten-year inheritance tail. Skip it if your sums assume box 3 will ignore the house, or that leaving the Netherlands ends Dutch inheritance tax at once: neither is true.
Can a Dutch citizen buy property in Crete?
Yes. A Dutch citizen buys in Crete with a Greek tax number (AFM) and a Greek bank account, and as an EU citizen needs no permit to own a home, live or work there. Someone who moves to Crete registers with the Greek police after three months.
Do I pay box 3 tax on a holiday home in Greece?
A Dutch resident declares a holiday home in Greece in box 3, at its market value, unoccupied and unrented, on 1 January of the year before; in 2026 box 3 assumes a 6.00% return on such assets, taxed at 36% above a €59,357 allowance. Dutch rules for avoiding double taxation can then reduce the box 3 tax by the home's share, and the 1981 Netherlands–Greece convention applies first. Have an adviser confirm the result for a home that is not let.
Is rent from a house in Crete taxed in the Netherlands?
Rent from a house in Crete is taxed in Greece, at 15% up to €12,000 and 25% up to €24,000 under the 2026 scale. In the Netherlands the house stays in box 3, which taxes a deemed return on its value rather than the rent itself, and Dutch double-tax rules can reduce that box 3 tax.
When does the new Dutch box 3 system start?
The Dutch cabinet wants a new box 3 on actual returns from 1 January 2028; in July 2026 the government said the Tweede Kamer had passed the bill and the Eerste Kamer still had to deal with it. Until then the deemed return applies, and a taxpayer whose actual return is lower can be taxed on that instead. Under the plan a second home's rise in value would be taxed only when realised, for example on a sale.
Do I still pay Dutch inheritance tax after emigrating to Crete?
Yes, for ten years if you are a Dutch national who lived in the Netherlands: article 3 of the Successiewet 1956 treats you as still resident if you die, or make a gift, within ten years of leaving. A separate one-year rule for gifts applies to anyone who lived in the Netherlands, whatever their nationality. The Dutch government's treaty overview lists no inheritance-tax treaty with Greece, so both countries can tax the Cretan house.
What happens to my AOW if I move to Crete?
Someone who emigrates and has no Dutch income stops building up AOW, and each uninsured year reduces the eventual AOW by 2%. The Sociale Verzekeringsbank offers voluntary AOW and Anw insurance, which the Dutch government says can be requested up to one year after moving abroad. AOW already built up is kept.
